Throughout these Terms, “we”, “us” and “our” refer to Zaira Jewelery. “You” and “your” refer to anyone accessing our website or purchasing products from us.

By accessing our website or placing an order, you agree to these Terms of Service. These Terms should be read alongside our:

Nothing in these Terms limits or excludes your statutory consumer rights.

If you are under 18, an order must be placed by, or with the permission and supervision of, a parent or legal guardian.

You must not use our website or products for any unlawful, fraudulent or unauthorised purpose.

  • Submit false, misleading or fraudulent information

5. Product Information

We take reasonable care to ensure that product descriptions, prices, measurements, materials and images are accurate.

Colours may appear slightly different because of screen settings, lighting or photography. Minor variations may also occur between plated, handmade or naturally finished products.

These minor variations do not affect your rights where a product is faulty, materially different from its description or otherwise does not conform to the contract.

Product packaging may differ from the packaging displayed on our website. All products are subject to availability.

6. Jewellery Care and Allergies

Product materials and relevant care information will be displayed on the product page where applicable.

You should review the listed materials before purchasing, particularly if you have a known allergy or sensitivity.

Normal wear and tear, accidental damage, misuse, improper storage, exposure to chemicals or failure to follow reasonable care instructions will not normally be considered a product fault.

This does not exclude our responsibility to provide accurate information or affect your statutory rights where a product is faulty, unsafe or incorrectly described.

7. Orders and Contract Formation

After placing an order, you will receive an email acknowledging that we have received it. This acknowledgement does not mean that your order has been accepted.

A legally binding contract is formed when we send you a dispatch confirmation email, unless we expressly confirm acceptance at an earlier stage.

We may decline or cancel an order before dispatch for reasons including:

  • Product unavailability

  • An obvious pricing or product-description error

  • Incomplete or inaccurate customer information

  • An unsuccessful or unauthorised payment

  • Suspected fraud or unlawful activity

  • Delivery restrictions affecting the destination

  • A breach of these Terms

If we cancel an order after payment has been taken, we will issue a full refund using the original payment method.

8. Preorders

Products identified as preorder items are not immediately available for dispatch.

An estimated processing or dispatch period will be displayed on the relevant product page. Unless expressly agreed otherwise, preorder dates are estimates and may change because of manufacturing, supplier, customs or shipping delays.

If a preorder is significantly delayed, we will contact you as soon as reasonably possible. Where required by law, you may cancel the affected order and receive a refund.

If an order contains both preorder and in-stock items, we may dispatch the entire order once all products are available. If you require in-stock items sooner, we recommend placing a separate order.

9. Prices, Currency and VAT

Our website’s default prices are displayed in pounds sterling (£). Other currencies may be displayed depending on your location and the options available through our website.

Prices include UK VAT where applicable. If VAT does not apply to a particular sale, it will not be charged merely because the product is sold through our website.

Delivery charges and any other applicable costs will be displayed before you complete your purchase.

For orders delivered outside the United Kingdom, import VAT, customs duties or handling fees may apply unless checkout expressly confirms that these charges are included.

We may change our prices at any time. Price changes will not affect orders that we have already accepted.

If a price is clearly incorrect and the error could reasonably have been recognised, we may cancel the order and refund any payment made.

10. Payment

Payment must be made using one of the methods offered at checkout.

By providing payment information, you confirm that:

  • The information is complete and accurate

  • You are authorised to use the selected payment method

  • Sufficient funds or credit are available to complete the purchase

Payments may be processed by Shopify or another authorised payment provider. Transactions may be subject to fraud-prevention and security checks.

11. Promotions and Discount Codes

Promotions and discount codes are subject to any specific conditions stated with the offer.

Unless otherwise stated:

  • Only one discount code may be used per order

  • Codes cannot be exchanged for cash

  • Codes cannot be applied retrospectively

  • Codes may exclude certain products, collections or delivery charges

  • Promotions are subject to product availability

  • Promotions may be amended or withdrawn before an order is accepted

Your statutory rights are not affected when purchasing a discounted or promotional product.

12. Delivery

Available destinations, delivery costs and estimated timeframes are explained in our Shipping Policy.

Unless a different timeframe has been agreed, orders will be delivered without undue delay and within 30 days after the contract is formed.

You are responsible for providing a complete and accurate delivery address.

We remain responsible for the goods until they are delivered to you or to a person identified by you to receive them. Different rules may apply if you independently arrange delivery using a carrier that we did not offer.

If we cannot deliver within an agreed essential timeframe, you may have the right to cancel the order and receive a refund.

13. UK 14-Day Right to Cancel

UK consumers purchasing online generally have the right to cancel an eligible order without giving a reason.

You must notify us within 14 days after the day you, or a person nominated by you, receives the goods.

After notifying us, you must return the goods within a further 14 days.

14. Refunds Following Statutory Cancellation

For an eligible statutory cancellation, we will refund:

  • The price paid for the returned goods

  • The cost of our least expensive standard delivery option, where applicable

If you selected a more expensive delivery method, we are not required to refund the additional cost above standard delivery.

Refunds will be provided without undue delay and no later than 14 days after:

  • We receive the returned goods; or

  • You provide acceptable evidence that the goods have been returned, if earlier

We may withhold the refund until we receive the goods or acceptable evidence of their return.

We may make a lawful deduction if the goods’ value has been reduced because they were handled beyond what was reasonably necessary to inspect their nature, characteristics and condition.

15. Earrings and Hygiene-Sensitive Products

For hygiene and health-protection reasons, earrings cannot be returned or exchanged once their hygiene seal or sealed protective packaging has been opened, removed, broken or damaged after delivery.

To qualify for a change-of-mind return, earrings must remain unused, unworn and fully sealed in their original protective packaging.

This restriction does not apply where the earrings are:

  • Faulty

  • Damaged upon arrival

  • Incorrectly supplied

  • Unsafe

  • Not as described

  • Otherwise not in conformity with the contract

16. Other Exceptions to Cancellation Rights

The statutory right to cancel may not apply to:

  • Personalised or custom-made jewellery

  • Goods made to your specifications

  • Sealed hygiene-sensitive goods once unsealed after delivery

  • Goods that have become inseparably mixed with other items

  • Other products excluded under applicable law

These exceptions do not remove your rights where a product is faulty, damaged, unsafe, incorrect or not as described.

17. Faulty or Incorrect Goods: UK Customers

Under the Consumer Rights Act 2015, products supplied to UK consumers must be:

  • Of satisfactory quality

  • Fit for their intended purpose

  • As described

  • In conformity with the contract

If a product does not meet these requirements, you may be entitled to:

  • Reject it and receive a refund, normally within 30 days

  • A repair or replacement

  • A price reduction

  • A final right to reject it and receive a refund

The appropriate remedy will depend on the circumstances.

We will cover reasonable return costs for goods that are faulty, damaged upon arrival, incorrect or not as described.

18. Irish and EU Customers

If we market or sell products to consumers in Ireland or another European Union country, those customers retain the mandatory consumer protections applicable in their country of residence.

These protections may include:

  • A 14-day right of withdrawal for eligible online purchases

  • A minimum two-year legal guarantee for faulty or non-conforming goods

  • Rights to repair or replacement

  • A proportionate price reduction

  • Termination of the contract and a refund, where applicable

Nothing in these Terms deprives an Irish or EU consumer of any mandatory protection that cannot legally be excluded or restricted.

Our Return Policy contains practical information about cancellations, returns, refunds and exchanges.

The Return Policy forms part of these Terms but does not replace, limit or exclude your statutory consumer rights.

Please contact us before returning an item so that we can provide the correct instructions and return address.

20. Website Availability and Third-Party Services

We aim to keep our website accurate, secure and available, but we cannot guarantee that it will always operate without interruption or technical error.

We may temporarily suspend or change parts of the website for maintenance, security or operational reasons.

Our website may contain links to third-party websites or use services provided by payment, delivery, analytics or technology providers.

We are not responsible for independent third-party websites that we do not operate. This does not exclude any responsibility we have for service providers acting on our behalf in fulfilling your order.

21. Intellectual Property

Unless otherwise stated, our website and its content—including the Zaira Jewelery name, branding, photographs, graphics, designs, text and logos—are owned by or licensed to Zaira Jewelery.

You may use the website for personal and non-commercial purposes only.

You must not copy, reproduce, distribute, modify, publish, sell or commercially exploit our content without prior written permission, except where permitted by law.

We process personal information in accordance with our Privacy Policy, the UK General Data Protection Regulation and the Data Protection Act 2018.

23. Our Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Defective products where liability cannot legally be excluded

  • Breach of your statutory consumer rights

  • Any other liability that cannot legally be excluded

If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable when the contract was formed.

Our products are intended for personal consumer use. If you use them for business purposes, we will not be responsible for business losses such as lost profit, revenue, opportunity or business interruption, to the extent permitted by law.

24. Events Outside Our Reasonable Control

We are not responsible for delays or failures caused by circumstances outside our reasonable control, such as severe weather, transport disruption, customs delays, strikes, natural disasters or communications-network failures.

If such an event materially affects your order, we will contact you and take reasonable steps to minimise the delay.

Your statutory rights, including any right to cancel because of substantial delay or non-delivery, remain unaffected.

25. Governing Law and Disputes

These Terms and contracts made through our website are governed by the laws of England and Wales.

If you live in Scotland or Northern Ireland, you retain any mandatory protections available under your local law and may generally bring proceedings in your local courts.

If you live in Ireland or another EU country, this choice of law does not deprive you of mandatory consumer protections provided by the law of your country of residence. You may also have the right to bring proceedings in that country.

Please contact us first if you have a complaint so that we can try to resolve it directly.

26. Changes to These Terms

We may update these Terms to reflect changes to our business, website, services or legal obligations.

The Terms in force when we accept your order will apply to that purchase. Later changes will not retrospectively alter an existing contract unless required by law or agreed with you.

The latest version will be published on this page with its effective date.

27. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, it will be treated as removed only to the extent necessary. The remaining provisions will continue to apply.
